Terms and Conditions
Terms & Conditions last updated and effective from: 26th August 2022.
1. Introduction
1.1 This agreement applies to all versions of the website and app developed by MathsBolt Limited, a company incorporated and registered in Ireland (Company Number 421788), with a registered office at 77 Hunter’s Hill, Ballycullen, Dublin 24.
1.2 By registering with or subscribing to MathsBolt, you are agreeing to be bound by the terms & conditions of this agreement. If you do not agree to all of the terms & conditions of this policy, please do not use, register with or subscribe to MathsBolt.
1.3 This agreement refers to any individual or institution which uses our services as a subscriber or user. This includes schools, teachers/school staff, parents & guardians and end-users.
1.4 Users are granted the right to use the MathsBolt website and app in accordance with these terms & conditions and all other rights are reserved.
2. Registration as a School/Teacher
2.1 To use the MathsBolt app you will first need to register, as the account administrator, your school with us. In so doing, you are confirming that you have the authority from your school to act on their behalf and enter into this agreement.
2.2 After setting up the administrator account for your school, you will then set up class teacher accounts. You will only set up accounts for teachers currently working in your school, and will delete their access rights as soon as they cease working in your school. Before setting up any teacher’s account you will receive the teacher’s consent to do so.
2.3 Any teacher subscribing to our website or app must also agree to be bound by our terms & conditions.
2.4 The school administrator/teacher shall obtain consent for any pupil they are setting a subscription up for. In registering a pupil, they are confirming they have received consent from that pupil’s parent or guardian.
2.5 The school administrator/teacher will ensure that only the appropriate people (designated teachers, parents/guardians) will have access to a pupils account and will ensure that access to a pupils QR login is limited to those appropriate people.
3. Registration as a Parent/Guardian
3.1 A parent can subscribe through the website and set up an individual account for their child/children and in doing so is agreeing to be bound by the terms & conditions.
3.2 In setting up a child’s account as a parent/guardian, you are confirming that you are the legal guardian of that child.
3.3 A parent can also set up their child’s subscription individually and add it to their school account by using the school’s class code which can be provided by the school administrator/class teacher.
4. Purchasing app subscriptions
4.1 The system requirements for using the app are set out in our FAQs. You should ensure that your device is compatible with these requirements before subscribing to and downloading the app.
4.2 The use of our website and app require an internet connection and you should ensure you have internet connectivity before subscribing.
4.3 Each subscription will provide a single user with access to the app content for the age/class group you have selected for the time period specified in your subscription and you will no longer have access to the app once that period has ended unless you re-subscribe. The subscription is for personal use and cannot be sub-licensed or sold on to any other party.
4.4 For each subscription, you will be issued with an individual QR Code for each user to grant them access to the app. The user’s QR Code should keep this safe at all times. If you have lost a QR Code, or believe that someone else has access to an account, you should immediately request a new QR code, which will cancel and replace any old one.
4.5 If we believe that our services are being used in a manner that is not intended by us or permitted under this agreement we reserve the right to terminate your subscription to our services.
4.6 Payment processing for you prescriptions will be provided by a third party and you should ensure that you are happy with their terms & conditions before proceeding with payment.
4.7 MathsBolt reserves the right to change its prices, but this will never impact a current subscription and we will always be fully transparent in our pricing.
5. Privacy Policy
5.1 All subscribers and users agree to be bound by our privacy policy, which can be found HERE.
5.2 To preserve users privacy, MathsBolt reserves the right to delete any school/user accounts after a reasonable period of inactivity on an account without a current subscription.
5.3 As part of the registration process for school administrators, teachers, parents and guardians you will need to create a login using your email address and a password. This data will be stored in accordance with our privacy policy and we ask that you keep your login details safe to prevent any unauthorized access to your account.
6. Intellectual Property and User Representations
6.1 All MathsBolt software, logos, graphics, gameplay design & features and content is owned by us and is protected by trademark, copyright and other intellectual property laws and MathsBolt reserves all rights relating to these.
6.2 Unauthorised use of the MathsBolt logos, graphics, features, content, trademarks, copyright and intellectual property are not permitted.
6.3 Users undertake not to modify, reverse engineer, decompile, disassemble, decipher or in any other way attempt to derive the source code for any software and intellectual property used by MathsBolt.
6.4 Users undertake not to obtain or attempt to obtain unauthorized access to our systems or data.
6.5 Users will not use the website or app in any manner that could damage, disable, impair or overburden them.
6.6 Circumvent, attack or disable any security or technological features that protect the website and app.
7. Software Updates
7.1 MathsBolt reserves the right to modify and update its software to improve the user experience and incorporate developments to our product at any time.
7.2 In order to synch MathsBolt across different devices and with the website, it is essential that all devices run the most up to date version of the app. Therefore, when an update is published, the next time the app is opened it will automatically install any updates.
8. Security
8.1 MathsBolt takes the security and privacy of all of its users very seriously and have put in place measures to keep all of our users data safe and secure, using industry best practice.
8.2 We will never ask you for your password and it is your responsibility to keep it secure at all times.
8.3 MathsBolt cannot guarantee that our security measures will never be breached. However, in the event of a security breach, we will inform all of our users as soon as we become aware and advise them of steps they can take to protect their data.
9. Technical difficulties and access
9.1 MathsBolt will endeavour to keep our website and app online and accessible whenever possible. There may be occasions when the site or app are inaccessible due to technical difficulties or while updates are being implemented, however we will always endeavour to keep these to a minimum.
9.2 You agree that MathsBolt will not be liable for any lack of availability of the website or app.
10. Warranty
10.1 You use MathsBolt at your own risk and no warranty is provided under these terms and conditions as to the reliability, suitability, accuracy or completeness of our product. MathBolt does not warrant that their products will be free from error or guarantee that its service will always be uninterrupted and protected from cyber attack, viruses and other harmful components.
10.2 MathsBolt website and app are provided ‘as is’ and you agree that your use of the website or app are at your own risk.
10.3 This does not limit any of your legal or statutory rights.
11. Liability and indemnity
11.1 The maximum that MathsBolt will be liable for in any dispute is the amount of the subscription at the time the issue was notified to us. MathsBolt will not be liable to any individual or school for any losses incurred through the use of its products beyond this amount.
11.2 MathsBolt will not be responsible for any breach of these terms and conditions caused by circumstances beyond our reasonable control.
11.3 By accepting this agreement, you hereby agree to indemnify MathsBolt against any liabilities, damages, judgments, costs and expenses arising out of your registration or subscription to the website or app, any downloading, installation and use of the MathsBolt software, or use of the services beyond the amount of your current subscription.
12. Dispute Resolution
12.1 If for any reason you are unhappy with the service provided by MathsBolt, we will endeavour to resolve the matter amicably and welcome communication from you to help@mathsbolt.com
13. Legal Jurisdiction
13.1 These Terms and Conditions are governed by Irish law. The courts of Ireland shall have exclusive jurisdiction in relation to any dispute arising from the use of the MathsBolt website or app.
14 Updates to User Agreement
14.1 MathsBolt reserves the right to update the terms & conditions and will post a notice on the website of any material or significant changes. If you continue to use MathsBolt after this notice, you agree to be bound by the updated terms & conditions.
